SENATE BILL NO. 136 An Act relating to the state budget and to                 
appropriation bills which had been returned to the Rules Committee             
(page 943) was read the second time.                                           
                                                                               
Senator Sharp moved and asked unanimous consent for the adoption               
of the Finance Committee Substitute offered on page 874.  Without              
objection, CS FOR SENATE BILL NO. 136(FIN) An Act relating                     
to the state budget, to agency performance reports, and to                     
appropriation bills was adopted and read the second time.                      
                                                                               
Senator Pearce offered Amendment No. 1 :                                        
                                                                               
Page 1, line 1, following "relating to":                                     
	Insert "state fiscal procedures, to"                                        
                                                                               
Page 2, following line 16:                                                     
	Insert a new bill section to read:                                            
   "* Sec. 4.  AS 37.05.316(a) is amended to read:                           
	(a)  When an amount is appropriated or allocated to                          
a department as a grant for a named recipient that is not a                    
municipality, the department to which the appropriation or                     
allocation is made shall promptly notify the named recipient                   
of the availability of the grant and request the named                         
recipient to submit a proposal to provide the goods or                         
services specified in the appropriation act for which the                      
appropriation or allocation is made.  ªAT THE SAME                             
TIME, THE DEPARTMENT MAY ISSUE A REQUEST                                       
FOR PROPOSALS FROM OTHER QUALIFIED PERSONS                                     
TO PROVIDE THE SAME GOODS OR SERVICES IN                                       
THE SAME AREA.  THE DEPARTMENT SHALL                                           
AWARD THE GRANT TO THE NAMED RECIPIENT                                         
UNLESS THE OFFICE OF THE GOVERNOR, WITH DUE                                    
REGARD FOR THE LOCAL EXPERTISE OR                                              
EXPERIENCE OF THOSE MAKING PROPOSALS,                                          
DETERMINES THAT AN AWARD TO A DIFFERENT                                        
PARTY WOULD BETTER SERVE THE PUBLIC                                            
INTEREST.  IF THE GRANT IS AWARDED TO A                                        
PARTY OTHER THAN THAT NAMED BY THE                                             
LEGISLATURE,  THE BASIS OF THAT ACTION SHALL

BE STATED IN WRITING AT THE TIME THE GRANT                                    
IS ISSUED AND A COPY OF THE WRITTEN                                            
STATEMENT SHALL BE SENT TO THE LEGISLATIVE                                     
BUDGET AND AUDIT COMMITTEE.ß  A grant agreement                                
must be executed within 60 days after the effective date of                    
the appropriation or allocation."                                              
                                                                               
Renumber the following bill sections accordingly.                              
                                                                               
Senator Pearce moved for the adoption of Amendment No. 1.

Without objection, the amendment to Amendment No. 1 was                        
adopted.                                                                       
                                                                               
There being no further objection, Amendment No. 1 as amended was               
adopted.

consent that the bill be considered engrossed, advanced to third               
reading and placed on final passage.  Without objection, it was so
